What can I expect if I proceed with a claim?

At My Insurance Claim, our team are experts in earthquake insurance and Earthquake Commission (EQC) claims.

We understand that when it comes to your property, you’re looking for peace of mind. Dealing with insurers or the EQC can seem daunting, and that’s where we can help.

Our specialist team will partner with you through every step of the claims journey to remove the stress of taking action, so that you can focus on getting on with your life. The claims journey typically unfolds in five stages; if you decide to bring your claim with us, here is what you can expect:

Claims Journey Stage
Stage 1: Obligation-free consultation

If you owned your property at the time of the earthquakes and answer ‘yes’ to any of the following questions, your property could still be damaged and you may be entitled to further payments from the EQC or your insurer:

  • Were you under the EQC cap?
  • Did EQC repair your property?
  • Did EQC pay you cash?
  • Were your foundations cracked?
  • Were, or are, your floors out of level?
  • Do your doors or windows jam?

During the initial obligation-free consultation, we’ll listen to you, discuss what’s happened with your property so far and make an initial assessment. Together, we can then discuss how best to progress your claim against the EQC, your insurer, or both.

Stage 2: Property inspection

We have a team of specialist forensic damage assessors who inspect, photograph and record full details of the damage to your property. This is presented and discussed with you in a Full Damage Report, so assessments can then be made as to how to best proceed with your insurance claims.

Stage 3: Policy review

While your property inspection is underway, we gather information from you on the work that the EQC have already completed on your home, and any payments that they have made to you. We also look at the role of the insurance company in your settlement. Key to that is reviewing your policy documents to ensure that you have the necessary coverage on top of what has been provided by the EQC.

Stage 4: Expert reports

Reports on Geotech (soil), Structural Engineering (Dwelling), and a Quantity Survey (cost of repairs) are often required to support your claim. These reports are collated with our own findings and coordinated into a complete claim for presentation to the EQC and insurer. Due to our No Win, No Fee* offering, you won’t be out of pocket for any of these reports.

Stage 5: Claims resolution

When it comes to resolving your claim, our goal is to negotiate a settlement with the EQC and insurer without legal action. However, if a satisfactory result cannot be achieved, your case will be reviewed, and subject to our mutual agreement, legal proceedings may need to be commenced to recover your loss.

It is common to reach a settlement prior to going to Court, however in instances where that is not possible, a determination will be required from the Court. We will work closely with you throughout this legal journey, ensuring that you are informed and supported each step of the way.

To ease the financial burden of taking action against the EQC and/or your insurer, we’ll run your claim on a No Win, No Fee* basis. This means you don’t need to pay us until we secure a successful outcome for you.
